TRANSPORTING REGULATIONS FOR OSKAR ANIMAL TAXI 

 

The regulations are based on the Animal Protection Act of August 21, 1997, marked in a DZ.U. of 2003 nr 106/1002, together with the later changes, and Council Regulation (EC) No 1/2005 of December 22, 2004. on the protection of animals during transport and related operations and amending Directives 64/432/EEC and 93/119/EC and Regulation (EC) No 1255/97.

 

§1

Veterinary requirements

  1. To be transported, the animals have to be healthy, in good condition enabling the procedure, with the exception of animals transported for medical reasons to veterinary clinics, after being classified by vets or after the owner’s agreement.
  2. An animal must not be younger than 9 weeks to be transported in Poland and 3 months to be transported abroad, unless the country to which the animal is transported allows it to be younger.
  3. The 2nd  point of the regulations does not apply if the animal younger than 9 months is accompanied by its mother.
  4. The transported animal has to be visibly signed by a chip or a tattoo. To be taken abroad it has to be signed by the chip only.
  5. The transported animal should be vaccinated for rabies intersection if older than 3 months.
  6. The transported animal should be dewormed not later than 24 hours before the travel and not earlier than 72 hours before the travel.
  7. The transported animal has to have the medical booklet to be transported in Poland and the passport to be taken abroad.
  8. If it is stated by other regulations ,the animal should also have the medical certificate issued by the Regional Veterinary Authority.
  9. The full responsibility for preparing the required documents  is on the side of the owner of the animal. The transporting company cannot be charged for any mistakes or insufficient documents.

 

§2

Transporting conditions

  1. The transporting is done in certified cages adjusted to the size of the transported animal.
  2. The rout is chosen to be as short as possible
  3. Both  the sender and recipient will be informed about the date and time when the animal will arrive at the destination, either by telephone or by mail.
  4. Oskar  Animal Taxi is not responsible for the time when the animal will arrive at the destination unless it is stated so in the written order.
  5. In case of force majeure which makes the transporting impossible by Oskar Animal Taxi, the order is still valid, but transporting will be postponed till the moment the force majeure does not prevent it.
  6. Oskar Animal Taxi does not insure an animal for the transporting, unless it is stated otherwise by both sides of the deal.
  7. The driver or the caretaker can refuse to take an animal if  the regulations from point 2 and 4 have not been observed.

 

§3

Sender and Recipient Responsibilities

  1. The sender is responsible for preparing all the necessary documents listed in point 2 by the day of departure
  2. To be transported an animal should be clean and property prepared.
  3. The recipient is obliged to be at the destination at the stated time given by Oskar Animal Taxi as it is described in point 3. The recipient will be immediately informed about any changes, either by telephone or by mail.

 

§4

Payment

  1. The payment for Oskar Animal Taxi is stated in agreement with the price list or on the base of an individual offer.
  2. The  money for the given order has to paid by the sender ( the recipient might be responsible for the payment if both sides agree) by the time of departure the latest, in cash or on the bank account given in the written deal. Oskar Animal Taxi may request the prepayment before the transporting starts.
  3. The payment for transporting an animal might be changed if
    1. the cost of the given transportation have changed and it was not possible for Oskar Animal Taxi to know it earlier. The changes might be caused by extra public payment, the cost of transporting itself, or similar
    2. while transporting an animal Oskar Animal Taxi was obliged or asked by the sender or the recipient to proceed above the standard regulations, or the order was changed by adding extra points, or some additional actions  had to be undertaken in the time of transporting
    3. The sender or the recipient had not informed Oskar Animal Taxi about all important aspects connected with transporting an animal.
    4. The time necessary for transporting was substantially prolonged and it was not caused by the way Oskar Animal Taxi was acting while transporting the animal
  4. The sender and the recipient are obliged to cover any costs Oskar Animal Taxi has to pay due to official regulations or when the costs are connected with cooperation with other companies for the execution of the order.
  5. The sender and the recipient are always responsible to cover the costs In the situation described in paragraph 3 point 7 in the amount of 2,00 PZL per each kilometer between the sender and Oskar Animal Taxi, or the place of delivery

 

§5

Final regulations

  1. The above rules for transporting animals apply in any deal between the sender and Oskar Animal Taxi, unless both sides decide otherwise.
  2. Cases which are not described in the regulations of this document will be dealt with in agreement with the Civil Code, International Civil Laws or generally accepted habits.
  3. Any derogation has to be done in a written form or will be otherwise not valid.
  4. All cases connected with executing orders by Oskar Animal Taxi  which require external decisions will be directed to the court appropriate for the place of Oskar Animal Taxi Oskar Pietrow company registration , that is to the court in Warsaw, and the above contract is the subject of the Polish law.
